Civil & Commercial Litigation

Not only have our attorneys represented the nation’s largest insurance companies, we have represented the legal interests of individuals as well. The breadth of our civil lawsuit experience has encompassed the areas of tort claims, settlements and compensation, contracts, construction disputes, municipal and real estate lawsuits. Our civil litigation lawyers also offer extensive litigation experience to corporate clients who require representation, either as a defendant or a plaintiff in a civil lawsuit. This includes a range of commercial litigation matters and disputes arising in the business context. We have handled cases across the commercial spectrum, including breach of contract cases, noncompetition provisions and noncompete clauses, partnership/joint venture disputes, commercial fraud, conspiracy, unfair trade practices, unjust enrichment, and business rots.

Corporate, Business & Contract Law

Since the inception of Walsh Pancio, our attorneys have been involved in the formation, representation, and counseling of numerous small business entities in Pennsylvania and elsewhere. These include corporations, subchapter S corporations, limited liability companies, partnerships, and limited partnerships. We provide business law advice, offer assistance in forming a corporation, review and draft contracts, non-compete agreements and covenants, as well as a range of related services. As a firm that is familiar with the needs of small businesses, we provide ongoing counsel to small businesses and guidance on a wide range of matters and issues.

Our trial lawyers also offer extensive experience in representing corporate, small business, and individual clients in commercial, business, partnership, and proprietorship disputes and disagreements. Insurance Law

Insurance Law represents the bulk of our legal practice. Walsh Pancio’s founding partners, Joseph P. Walsh and Bruce Pancio, have dedicated substantial parts of their legal careers to the representation of insurance companies, insureds, and self-insured entities. The firm was established with a commitment both to excellence in the representation of the insured client and efficiency in the administration of the files for the insurers. We are an insurer’s alternative to the bureaucracy and hidden costs of a large law firm. The attorneys at Walsh Pancio offer clients the highest level of legal acumen, with personal attention, prompt and regular communication, and a bottom line consistent with our efficient file handling.

We are privileged to represent some of the largest insurers in the Commonwealth of Pennsylvania, including State Farm Insurance Company, Erie Insurance Group, Philadelphia Insurance Company, and their insureds. Walsh Pancio has handled a variety of civil lawsuits, from small claims to complex, multi-party lawsuits. We treat each case as significant and dedicate our highest levels of service and attention to it, no matter how small.

Our insurance law practice has included the following types of claims: catastrophic casualty events, serious and fatal injury claims, commercial, homeowner, premises liability, insurance fraud and special investigations, UM/UIM, motor vehicle liability, medical negligence, professional malpractice, products liability, municipal liability, subrogation, coverage and bad faith.

The cost of legal representation is always a concern. Our attorneys have worked on reasonable hourly rates and flat fee arrangements, as well as a combination of flat fee and hourly rate. The attorneys at Walsh Pancio are always willing to discuss the appropriate fee arrangement which best meets the client’s need.

Municipal and Zoning

Our attorneys possess many years of experience representing clients in both residential and commercial real estate matters. For both sellers and buyers of commercial and residential properties, we review and negotiate property sales agreements, represent clients in foreclosure cases, and handle landlord/tenant rights matters including review and negotiation of leases and commercial and residential real estate rental agreements. Our attorneys also represent clients at court in real estate disputes. The attorneys at Walsh Pancio have served as Solicitor to zoning hearing boards and have represented clients in zoning matters.

Construction Defects

Consistent with our extensive civil and commercial litigation experience, our firm has handled hundreds of construction defect disputes for major builders, insurance companies, and small contractors. We handle cases involving design deficiencies, materials deficiencies and failures, substandard workmanship, toxic mold, stucco and other matters.

The attorneys at Walsh Pancio have tried numerous construction arbitrations, provided counsel on coverage issues, and actively litigated these issues in all levels of the Pennsylvania court systems, including litigating appeals all the way to the Supreme Court of Pennsylvania.

Wills, Estates & Trusts

Our attorneys at Walsh Pancio provide estate planning counseling to individuals and business owners. This includes the drafting of living wills and trusts, wills, trusts, powers of attorney, and other related documents. In addition to the estate planning document preparation, we provide legal counsel throughout the administration of estates.

Arbitration and Mediation

Through their substantial courtroom experience in a wide variety of cases, Walsh Pancio attorneys have gained a reputation as unbiased, meticulous, and understanding. Based on that reputation, the firm’s attorneys are routinely called upon—by plaintiffs and defendants alike—to serve as private third-party neutrals in mediations, arbitrations, and other alternative dispute resolution proceedings. Not only have our attorneys had great success as advocates, but our attorneys have been recognized by multiple courts to serve in a number of roles where they were fortunate to help litigants resolve their disputes outside the courtroom.  The Honorable Joseph P. Walsh draws upon his experience as a former judge of the Court of Common Pleas of Montgomery County in resolving many different types of cases, and continues to serve the county as a civil case master, where he frequently assists parties in resolving active civil matters. Bruce Pancio, Esq. served as member of the Montgomery Bar Association’s Center for Mediation and Arbitration, and was appointed by the President Judge of the Court of Common Pleas of Montgomery as a discovery master.

The firm uses this experience, along with its substantial breadth of experience in litigating cases in state and federal throughout the Commonwealth of Pennsylvania, to help parties work in a productive manner toward a mutually beneficial result.  All mediations, arbitrations, and third party neutral proceedings are conducted with an entirely unbiased and neutral examination of the facts, law, and circumstances.  Where appropriate, the firm uses advanced communication technology for these proceedings at the agreement of the parties.

As with our representation of our previous clients, our attorneys represent our personal injury clients while adhering to our mission of aggressive, ethical representation.

Like any cases it has handled on behalf of defendants and insureds, we carefully analyze each personal injury claim. We thoroughly discuss the pros and cons of each case with each of our clients and cooperatively determine a strategy that will best serve them. While many personal injury cases do not go to trial, our attorneys embrace that possibility and approach each case with an assumption that it will and look forward to trying cases where it becomes necessary to do so. Where the best possible outcome is a negotiated settlement or resolution out of court, we work tirelessly to ensure that their personal injury clients are fairly compensated for their injuries and satisfied with the outcome of every case. Local Counsel

Attorneys at Walsh Pancio regularly serve as local counsel and co-counsel for state court matters in the Greater Philadelphia area. Our role as local counsel is shaped by our decades of experience in the state courts.

Walsh Pancio can perform narrowly tailored services, such as preparing pro hac vice motions and other routine case filings; advising referral counsel and co-counsel about local rules and procedures; and offering insight as to the preferences, quirks and style of the local judges in and around Philadelphia.  On the other hand, Walsh Pancio is also capable of playing a major role in cases when acting as local legal counsel, and our attorneys can fill in seamlessly in the position of first chair.
